  • Client names, contact information, and business operations are never disclosed without explicit written consent
  • All communication channels are encrypted and secure
  • Employee and contractor access to client data is strictly controlled and monitored
  • Non-Disclosure Agreements (NDAs) are honored and enforced at all times

2. Data Protection

We collect and process personal information in accordance with international data protection laws, including GDPR and applicable local regulations:

  • Information is stored securely using industry-standard encryption
  • Data is retained only as long as necessary for business operations

Terms of Service

1. Portfolio Usage Rights

Orvynexia reserves the right to showcase completed projects in our portfolio under the following conditions:

  • Only projects without Non-Disclosure Agreements (NDAs) will be included in our public portfolio
  • Client approval will be sought before adding any project to our portfolio
  • Projects under NDA or confidentiality agreements will never be publicly displayed
  • Client names and sensitive business information may be anonymized upon request
  • Clients may request removal of their project from our portfolio at any time

2. Payment Terms & Conditions

All projects are subject to the following payment structure and terms:

  • Advance Payment: A minimum of 40% advance payment is required before project commencement
  • Milestone Payments: Remaining payments will be structured according to project milestones as outlined in the contract
  • Payment Methods: We accept bank transfers, PayPal, Stripe, and other agreed-upon payment methods
  • Late Payments: Projects may be suspended if milestone payments are not received within the agreed timeframe
  • Contract Terms: Alternative payment structures may be negotiated and documented in the service contract
  • Currency: All payments are processed in USD unless otherwise agreed

3. Fiverr Projects - Special Terms

Projects initiated through Fiverr are subject to specific handling procedures:

  • All Fiverr projects must be managed exclusively through the Fiverr platform
  • Communication regarding Fiverr projects must occur only through Fiverr messaging system
  • Payments for Fiverr projects must be processed exclusively through Fiverr
  • No personal email, phone communication, or external payment methods for Fiverr projects
  • This policy ensures compliance with Fiverr Terms of Service and protects both parties
  • Violations of this policy may result in project termination and account suspension

4. Intellectual Property Rights

  • Upon full payment, all deliverables and final code become the client's property
  • Orvynexia retains rights to proprietary tools, frameworks, and methodologies used
  • Open-source components remain subject to their original licenses
  • Source code is transferred upon project completion and final payment
  • Clients receive full commercial rights to use, modify, and distribute the final product

5. Project Delivery & Timelines

  • Project timelines are agreed upon in the initial contract or proposal
  • Delays caused by client feedback or requirement changes may extend deadlines
  • We provide regular progress updates and milestone completions
  • Force majeure events may affect delivery schedules (will be communicated promptly)
  • Expedited delivery may be available at additional cost

6. Refund & Cancellation Policy

  • Advance payments are non-refundable once work has commenced
  • Cancellations must be requested in writing
  • Clients will be charged for work completed up to the cancellation date
  • Partial refunds may be considered on a case-by-case basis
  • Completed milestones are non-refundable

7. Warranty & Support

  • We provide 30 days of free bug fixes and technical support post-delivery
  • Extended support and maintenance packages are available
  • Warranty covers defects in functionality, not changes in requirements
  • Third-party services and APIs are not covered under our warranty
  • Support response time is within 24-48 business hours

8. Limitation of Liability

Orvynexia's liability is limited as follows:

  • Maximum liability is limited to the total project value
  • We are not liable for indirect, consequential, or punitive damages
  • Client is responsible for data backup and disaster recovery
  • We are not responsible for third-party service failures
  • Force majeure events release us from contractual obligations

9. Dispute Resolution

  • Disputes will first be attempted to resolve through good-faith negotiation
  • Mediation by a neutral third party may be pursued if negotiation fails
  • Arbitration in accordance with international commercial arbitration rules
  • Legal jurisdiction: Pakistan (unless otherwise specified in contract)
  • All communication regarding disputes must be in writing

10. Compliance & Legal

  • All services comply with applicable laws and regulations
  • We adhere to international standards for data protection (GDPR, CCPA)
  • Projects will not be accepted for illegal, unethical, or harmful purposes
  • We reserve the right to refuse service to anyone
  • These terms are governed by Pakistani law and international commercial standards
